Turkey indictment report: “A threat to journalists and the fundamental right to recieve information”
PEN Norway’s new report exposes the serious legal flaws in the indictment filed against journalist Fırat Bulut for his reporting following the 2023 earthquakes. PEN Norway stands for press freedom and the right to report truth.
In its latest report within the Turkey Indictment Project, PEN Norway provides an in-depth analysis of the indictment against journalist Fırat Bulut. Bulut is prosecuted under Article 217/A of the Turkish Penal Code (“Publicly Disseminating Misleading Information”) for sharing a video showing smoke rising from Elbistan Type E Prison following the February 2023 earthquakes. The report demonstrates that the legal basis for this charge is fundamentally flawed under both domestic and international human rights standards.
The findings further show that the indictment fails to meet basic evidentiary requirements and disregards the fact that the incident Bulut reported was officially confirmed. Continuing the prosecution despite these facts raises profound concerns for press freedom and the protection of journalistic work in Turkey.
Report author Florian Bohsung captures this concern clearly:

Bulut, 6 Şubat 2023 depremlerinin ardından Elbistan E Tipi Cezaevi’nden yükselen dumanları gösteren bir videoyu paylaşması nedeniyle “Halkı Yanıltıcı Bilgileri Alenen Yayma” (TCK 217/A) suçlamasıyla yargılanıyor. Raporda bu suçlamanın dayandığı varsayımların hem iç hukuk hem de uluslararası insan hakları normları açısından sorunlu olduğu ortaya konuluyor.
Raporun bulguları, özellikle iddianamenin temel unsurları yerine getirmediğini ve resmi kurumların cezaevinde yangın çıktığını doğrulamasına rağmen kovuşturmanın sürdürülmesinin ifade özgürlüğü açısından ciddi riskler taşıdığını ortaya koyuyor. Bu durum, hem delillere yaklaşım hem de gazetecilik faaliyetinin korunması bakımından iddianamenin ciddi eksikliklere sahip olduğunu açıkça gösteriyor.
Raporun yazarı Florian Bohsung bu tabloyu şöyle özetliyor:
“Bulut’un paylaştığı bilgi gerçeğe uygun olduğu hâlde yargılamanın sürdürülmesi, yalnızca gazetecileri değil, toplumun haber alma hakkını da doğrudan tehdit etmektedir.”
