Last Turkey Report of 2025: “Lawyers must be free to advocate for their clients without fear of retaliation”
Legal Report on the Indictment of Lawyer Ümit Büyükdağ highlights the impact of such prosecutions on lawyers’ freedom of expression and the right to defence.
PEN Norway has published a new legal report analysing the indictment brought against lawyer Ümit Büyükdağ, prepared in cooperation with Lawyers for Lawyers
Authored by Maxwell Goddard and Ryan Bestford, the report examines criminal proceedings initiated after Büyükdağ criticised prosecutorial conduct while acting in her professional capacity as defence counsel in a terrorism-related case. Although she was acquitted in March 2025, the case remains pending on appeal, maintaining the relevance of the analysis.
The report demonstrates that the indictment improperly attributes statements made in the course of legal defence to criminal conduct and seeks to equate the lawyer’s professional actions with the alleged acts of her client.

As the authors note, “at the heart of this case lies the fundamental principle that lawyers must be free to advocate for their clients without fear of retaliation or prejudice by the prosecuting authorities.” The indictment fails to provide a reasoned explanation as to why the impugned statement constitutes a criminal insult and disregards procedural safeguards under domestic law.
Measured against international standards, the report finds that prosecuting a lawyer for good-faith statements made in the context of legal defence is incompatible with the UN Basic Principles on the Role of Lawyers and Article 10 of the European Convention on Human Rights. Referring to the case law of the European Court of Human Rights, the authors recall that lawyers must be able to criticise the administration of justice without exposure to criminal sanctions.
The report concludes that prosecutions of this nature impair the effective exercise of the right to defence by placing defence lawyers under the threat of criminal liability for their professional speech.
PEN Norway highlights that restrictions on lawyers’ freedom of expression in the course of their professional duties have direct consequences for access to justice and the proper functioning of the rule of law.

Avukat Ümit Büyükdağ Hakkında Düzenlenen İddianamenin Hukuki İncelemesi
PEN Norveç, Lawyers for Lawyers (L4L) işbirliğiyle, Avukat Ümit Büyükdağ hakkında düzenlenen iddianameye ilişkin bir hukuki inceleme raporu yayımladı. Maxwell Goddard ve Ryan Bestford tarafından kaleme alınan rapor, Büyükdağ’ın bir terör davasında savunma avukatı sıfatıyla görev yaparken savcılık makamının tutumuna yönelik eleştirileri nedeniyle başlatılan ceza yargılamasını incelemektedir. Büyükdağ 2025 Mart ayında beraat etmiş olsa da dosyanın istinaf aşamasında bulunması, raporun güncelliğini korumasına neden olmaktadır.
Raporda, iddianamenin savunma faaliyeti kapsamında yapılan açıklamaları suç teşkil eden fiiller olarak değerlendirdiği ve avukatın mesleki faaliyetlerini müvekkiline isnat edilen fiillerle ilişkilendirdiği ortaya konulmaktadır. Yazarların da belirttiği üzere, “bu davanın merkezinde, avukatların kovuşturma makamları tarafından misillemeye uğrama korkusu olmaksızın müvekkillerini savunabilmeleri gerektiği ilkesi yer almaktadır.” İddianamenin, söz konusu ifadelerin neden hakaret suçu oluşturduğunu hukuken gerekçelendirmediği de vurgulanmaktadır.
Uluslararası standartlar ışığında yapılan değerlendirmede, savunma görevi sırasında iyi niyetle yapılan açıklamalar nedeniyle bir avukatın cezai soruşturmaya tabi tutulmasının, BM Avukatların Rolüne Dair Temel Prensipler ile Avrupa İnsan Hakları Sözleşmesi’nin 10. maddesiyle bağdaşmadığı tespit edilmektedir. Raporda, AİHM içtihadına atıfla, avukatların adaletin işleyişine ilişkin eleştirilerini cezai yaptırım tehdidi altında kalmaksızın dile getirebilmeleri gerektiği hatırlatılmaktadır.
Ayrıca raporda, bu tür kovuşturmaların savunma hakkının etkin kullanımını zedelediği ve avukatların mesleki faaliyetleri kapsamında ifade özgürlüğü üzerinde caydırıcı bir etki yarattığı sonucuna varılmaktadır. PEN Norveç, savunma avukatlarının mesleki ifade özgürlüğüne yönelik bu tür sınırlamaların adalete erişim ve hukukun üstünlüğü açısından doğrudan sonuçlar doğurduğuna dikkat çekmektedir.
