Özgür Gündem-rettssaken utsettes – igjen
Menneskerettighetsforkjemperne Erol Önderoğlu, prof. Dr. Şebnem Korur Fincancı og Ahmet Nesin måtte igjen møte i retten torsdag 30. januar 2025. Norsk PEN var til stede i rettshuset i Istanbul.
Önderoğlu, Fincancı og Nesin ble arrestert for åtte år siden for å ha fungert som sjefredaktører, i én dag, for den kurdiske avisen Özgür Gündem. Önderoğlu, Reportere uten grensers Tyrkia-representant, Fincancı, tidl. president for den tyrkiske legeforeningen, og skribenten Nesin, er siktet for «spredning av propaganda til fordel for en terrororganisasjon», «offentlig oppfordre andre til å begå lovbrudd» og «godkjenne kriminalitet og kriminelle».
De ble frikjent i 2019, men saken ble imidlertid gjenåpnet i 2021 etter at dommen ble opphevet.
Norsk PEN var til stede på deres forrige høring 15. oktober 2024. Neste høring i saken vil finne sted 29. april 2025. Norsk PEN følger saken tett.

Nine-Year Trial of Özgür Gündem’s Editors-in-Chief on Duty Continues
The trial of Erol Önderoğlu, Reporters Without Borders Turkey Representative, Prof. Dr. Şebnem Korur Fincancı, former president of the Turkish Medical Association, and author Ahmet Nesin – who are being prosecuted for taking part in the 2016 “Editor-in-Chief on Watch” campaign to highlight the pressures against Özgür Gündem newspaper – resumed on 30 January 2025.
The hearing held at 13th High Criminal Court of İstanbul was attended by the journalist Erol Önderoğlu and his lawyer. Together with PEN Norway, the Netherlands and France consulates, Media and Law Studies Association and P24 Platform for Independent Journalism followed the hearing as observers.
The presiding judge decided to await the response to the court’s letter requesting the testimony of author Ahmet Nesin, who is currently abroad. Therefore, the court adjourned the hearing to 29 April at 10:00.
Chronology of events
Acting in solidarity with Özgür Gündem Newspaper, Erol Önderoğlu, Reporters Without Borders Turkey Representative, Prof. Dr. Şebnem Korur Fincancı, former President of the Turkish Medical Association and author Ahmet Nesin had participated in the Editors-in-Chief on Duty campaign and were arrested on 20 June 2016 on charges of “disseminating propaganda in favour of a terrorist organisation”. Released after 10 days of detention, Önderoğlu, Fincancı and Nesin were charged with “condoning crime and criminals”, “disseminating propaganda in favour of a terrorist organisation” and “publicly inciting others to commit an offence” at Istanbul 13th High Criminal Court. The trial ended with an acquittal on 17 July 2019, but the verdict was overturned by the Court of Appeal on 20 October 2020. The reasoning of the Court of Appeal’s verdict argued that the acquittal had violated the procedures. Thereupon, the case was sent back to the local court for retrial. The retrial cannot proceed because the testimony of writer Ahmet Nesin cannot be taken as he is abroad.
PEN Norway had published a full report on the indictment that was the basis for this case. The report found that the indictment itself seriously violated the rights to freedom of expression and freedom of the press. Özgür Gündem Nöbetçi Genel Yayın Yönetmenliği Davası dokuz yıldır sürüyor
Özgür Gündem gazetesine yönelik baskıya dikkat çekmek için 2016 yılında başlatılan bir günlük Nöbetçi Genel Yayın Yönetmenliği kampanyasına katıldıkları için yargılanan Sınır Tanımayan Gazeteciler Örgütü Türkiye Temsilcisi Erol Önderoğlu, Türk Tabipleri Birliği Merkez Konseyi eski Başkanı Prof. Dr. Şebnem Korur Fincancı ve yazar Ahmet Nesin’in yargılandığı davaya 30 Ocak 2025 tarihinde devam edildi.
İstanbul 13. Ağır Ceza Mahkemesi’nde görülen 12. duruşmaya Erol Önderoğlu ve, avukatı katıldı. Duruşmayı PEN Norveç’in yanı sıra, Hollanda ve Fransa konsoloslukları, Medya ve Hukuk Çalışmaları Derneği ve P24 Bağımsız Gazetecilik Platformu da gözlemci olarak takip etti.
Mahkeme başkanı, yurtdışında bulunan yazar Ahmet Nesin’in ifadesinin alınması için yazılan talimat evrakının cevabının beklenmesine karar verdi. Mahkeme bu nedenle duruşmayı 29 Nisan saat 10:00’a erteledi.

Sınır Tanımayan Gazeteciler Örgütü Türkiye Temsilcisi Erol Önderoğlu, eski Türk Tabipleri Birliği Başkanı Prof. Dr. Şebnem Korur Fincancı ve yazar Ahmet Nesin, Özgür Gündem gazetesiyle dayanışmak için yayın yönetmenliği kampanyasına katılmış, savcılığın açtığı soruşturma kapsamında 20 Haziran 2016’da “terör örgütü propagandası yapmak” suçlamasıyla tutuklanmışlardı. 10 gün süren tutukluluktan sonra tahliye edilen Önderoğlu, Fincancı ve Nesin hakkında “suçu ve suçluyu övme”, “terör örgütü propagandası yapmak” ve “suç işlemeye alenen tahrik etme” suçlamalarıyla İstanbul 13. Ağır Ceza Mahkemesi’nde dava açıldı. Dava, 17 Temmuz 2019’da beraat kararıyla sonlandı, ancak bu karar 20 Ekim 2020’de istinaf mahkemesi tarafından bozuldu. Kararın gerekçesinde, beraat kararının usule aykırı olduğu savunuldu. Bunun üzerine dosya yeniden yargılama yapılması için yerel mahkemeye geri gönderildi. Yeniden yargılama, yurtdışında bulunan yazar Ahmet Nesin’in ifadesi alınamadığı için ilerleyemiyor.
PEN Norveç bu duruşmaya dayanak olan iddianameye ilişkin bir inceleme raporu yayımlamış ve raporda ilgili iddianamenin ifade ve basın özgürlüğü haklarını ciddi şekilde ihlal ettiği tespitine yer verilmişti. İlgili raporu okumak için: Microsoft Word – Özgür Gündem TR.docx (norskpen.no)
